The General Instruction on Exchange Operations (IGOC) 2026 defines four key statuses in Morocco: resident, non-resident, MRE (Moroccan residing abroad), and resident foreigner. Understanding these distinctions is vital for bank accounts, transfers, investments, and reporting obligations. Discover the rules applicable to each profile and how iHub can assist you.

Understanding Exchange Status in Morocco: IGOC 2026

The General Instruction on Exchange Operations (IGOC) 2026 outlines four distinct exchange statuses in Morocco: Moroccan resident, foreign non-resident, Moroccan residing abroad (MRE), and foreigner residing in Morocco. Each status dictates authorized bank accounts, transfer rights, investment opportunities, and reporting obligations. This article details the rules applicable to each profile.

Why Exchange Status is Crucial

Moroccan exchange regulations are based on a fundamental principle: the partial convertibility of the Dirham. Any operation involving a foreign currency – transfer, investment, repatriation – is regulated by the Exchange Office. The exchange status of an individual or legal entity determines all their rights and obligations concerning capital movements.

With the overhaul of the IGOC, which came into force in 2026, rules have been clarified and certain ceilings raised, but the logic of status remains the cornerstone of the entire system.

The Four Exchange Statuses: A Summary Table

StatusDefinitionExamples
Moroccan ResidentIndividual of Moroccan nationality having their habitual residence in MoroccoEmployee, entrepreneur, retiree living in Morocco
Foreign Non-ResidentIndividual or legal entity of foreign nationality not having their habitual residence in MoroccoForeign investor, foreign parent company, tourist
MRE (Moroccan Residing Abroad)Individual of Moroccan nationality having their habitual residence outside MoroccoMoroccan expatriate in France, Canada, UAE
Foreigner Residing in MoroccoIndividual of foreign nationality having their habitual residence in MoroccoExpatriate executive, foreign spouse, foreign retiree settled in Morocco

The qualification of status is assessed with regard to habitual residence, a notion distinct from tax residence. A Moroccan settled abroad for more than six months is considered an MRE under exchange regulations.

Moroccan Resident: The Common Law Regime

The Moroccan resident operates exclusively in Dirhams. Their bank accounts are denominated in national currency, and they can only hold foreign currency accounts exceptionally (travel allowances, study allowances).

  • Authorized Bank Accounts: Current and savings accounts in Dirhams with Moroccan banks.
  • Possible Investments: Domestic investments without restriction. Investment abroad is subject to prior authorization from the Exchange Office, except within the framework of the investment allowance (annual ceiling set by circular).
  • Transfer Rights: Annual tourist allowance (increased to 100,000 MAD in 2026), study allowance, emigration allowance. Commercial transfers are free within the framework of duly domiciled imports.
  • Reporting Obligations: Declaration of foreign assets if applicable, compliance with allowance ceilings, travel justifications.

Foreign Non-Resident: Total Convertibility

The foreign non-resident benefits from the most favorable exchange regime. The guiding principle is the guarantee of transfer and convertibility for capital introduced into Morocco via banking channels.

  • Authorized Bank Accounts: Convertible Dirham accounts and foreign currency accounts with Moroccan banks. These accounts are freely funded by transfers from abroad.
  • Possible Investments: Direct and portfolio investments without ceilings, subject to the regular entry of funds. The transfer of dividends is guaranteed without limit of amount.
  • Transfer Rights: Full repatriation of invested capital, capital gains, and income (dividends, interest, rents). Transfer is made upon simple presentation of banking and tax justifications.
  • Reporting Obligations: Investment declaration with the Exchange Office for direct investments, foreign currency import certificate for real estate investments.

MRE: An Advantageous Hybrid Regime

The Moroccan residing abroad has a specific status that combines advantages of both residents and non-residents. IGOC 2026 has consolidated and expanded their prerogatives.

  • Authorized Bank Accounts: MREs can open three types of accounts in Morocco:
    • Ordinary Dirham Account: Funded by transfers from abroad or local income, usable for current expenses in Morocco.
    • Convertible Dirham Account: Funded exclusively by transfers from abroad, guaranteeing the reconversion of available balances into foreign currencies.
    • Foreign Currency Account: Denominated in Euro, Dollar, or other quoted currency, funded by transfers from abroad.
  • Possible Investments: MREs can freely invest in Morocco in real estate, securities, UCITS, and participations in Moroccan companies. Investments financed by convertible Dirham accounts or foreign currency accounts benefit from the transfer guarantee.
  • Transfer Rights: MREs can transfer investment income (rents, dividends) and proceeds from asset sales abroad, provided the initial investment was financed by repatriated foreign currencies. The repurchase of foreign currency for non-convertible Dirham assets is capped at 100,000 MAD per year.
  • Reporting Obligations: Investment declaration for participations and real estate, justifications of foreign currency financing to benefit from the transfer guarantee.

Foreigner Residing in Morocco: Assimilated Resident with Adjustments

Foreigners settled in Morocco are subject to the exchange regulations applicable to residents. However, specific adjustments allow them to repatriate a portion of their income.

  • Authorized Bank Accounts: Dirham accounts (common law regime). Opening a foreign currency account is possible for funds from abroad, but convertibility remains limited.
  • Possible Investments: Same regime as the Moroccan resident for domestic investments. Investment abroad is subject to the same restrictions.
  • Transfer Rights: Resident foreigners can transfer their net salary savings (after payment of income tax and social charges) without limitation. Transfer of retirement pensions acquired in Morocco is also authorized. However, capital transfers are subject to authorization.
  • Reporting Obligations: The same as those of Moroccan residents, with the production of employment or income justifications for salary savings transfers.

Practical Impacts on Investment and Company Creation

The choice of exchange status has direct consequences on structuring an investment or the creation of a company in Morocco:

  • Foreign Currency vs. Dirham Financing: Only an investment financed by repatriated foreign currencies benefits from the guarantee of income and capital transfer. An MRE who uses their ordinary Dirham account loses this guarantee.
  • Company Creation by a Non-Resident: Capital contribution must pass through a convertible Dirham account. The foreign currency import certificate is essential for future repatriation of dividends.
  • Resident Foreigner Creating a Company: They are subject to the resident regime. Their dividends as a partner are only transferable within the limits of the provisions applicable to residents.

It is essential to correctly structure flows from the outset. Support from an accountant familiar with exchange regulations, like iHub, helps avoid blockages at the time of repatriation of funds.

What to Remember

IGOC 2026 maintains an architecture based on four distinct exchange statuses. The foreign non-resident benefits from the widest convertibility, the MRE from a hybrid regime with convertible accounts and a foreign currency repurchase ceiling of 100,000 MAD per year, while the Moroccan resident and the resident foreigner remain subject to the partial convertibility of the Dirham. Status conditions every operation: opening an account, investing, transferring funds, or repatriating profits. Consulting with experts at iHub can simplify these complex regulations, ensuring your compliance and optimizing your financial operations in Morocco.
